"My son’s new school requires all volunteers, even parents who just read a story in class once a month, to submit to a background check". This costs money and can be very time consuming. After a recent news story was aired, however, I find this less of an annoyance and more of a necessity. A man was arrested recently in Arizona for suspected molestation of children. "But had this regulation been put in place previously, it might have prevented this atrocious act." Exactly, that is the point of background checks to minimize risks based on previous behavior.

While Anita Collins may have broken the Thou Shalt Not Steal commandment, the Archdiocese probably broke a fiscal commandment: Do background checks on your employees. This was not the first time Collins had been charged with grand larceny. "Once a con, always a con". This is living proof why an employer should conduct background checks. A simple $30.00 background check would have uncovered her past financial crimes, yet it ended up costing them $1 million. If they still want it to employ her based on "redemption", they would have assigned her to a position where she would not have been handling finances as it does not appear that her past criminal record was of violent nature.

"A criminal background check will tell someone what their lover has done in the past, but not necessarily what they're up to now." This comes a few days after a Toronto human resources firm called for all dating sites to make users supply a criminal background check as part of the registration process.

Pepsi Beverages Co. has agreed to pay $3.1 million to settle federal charges of race discrimination for using criminal background checks to screen out job applicants — even if they weren't convicted of a crime. The Equal Employment Opportunity Commission, which is working to crackdown on hiring policies that can hurt blacks and Hispanics, said Wednesday that the company's policy of not hiring workers with arrest records disproportionately excluded more than 300 black applicants. The policy barred applicants with arrest records even if they had never been convicted of a crime, and denied employment to those arrested or convicted of minor offenses. Using arrest and conviction records to deny employment can be illegal if it's irrelevant for the job, according to the EEOC, which enforces the nation's employment discrimination laws. The agency says such blanket policies can limit job opportunities for minorities with higher arrest and conviction rates than whites. The company has since adopted a new criminal background policy and plans to make jobs available to victims of the old policy if they are still interested in jobs at Pepsi and are qualified for the openings.

The December 2011 NSSF-adjusted National Instant Criminal Background Check System (NICS) figure of 1,410,937 is an increase of 24.5 percent over the NSSF-adjusted NICS figure of 1,133,371 in December 2010. "This marks the nineteenth straight month that NSSF-adjusted National Instant Criminal Background Check System (NICS) figures have increased when compared to the same period the previous year."

Re “Many in U.S. Are Arrested by Age 23, Study Finds” (news article, Dec. 19): About one-third of American adults have criminal records, complicating their job search dramatically. Research underwritten by the National Institute of Justice shows that even accurate arrest records may be of little use in pre-employment screening, particularly when arrests date back many years.

Come New Year's Day, employers in San Francisco and the rest of California will need to be in compliance with two new laws that will change the way they conduct background checks beginning on January 1, 2012: California Assembly Bill 22 (CA AB 22), which relates the use of credit report checks of job applicants and current employees for employment purposes, and California Senate Bill 909 (CA SB 909), which relates to the “offshoring” of the Personally Identifiable Information (PII) of consumers who are the subjects of background checks.
