CERTIFICATION: By choosing to submit this form electronically, I certify and agree that by electronically SUBMITTING my name and credit card payment information, I bind and legally obligate myself to the same extent as I would by signing my name on a printed version of this form. I also certify that I have read, understand and accept the Terms and Conditions and General Use of Data stated below. I also give permission to Background Checks Systems, Inc. (BCS) to use my credit card for payment of searches requested.

READ CAREFULLY BEFORE SUBMITTING SEARCH ORDER: TERMS AND CONDITIONS: This agreement is made subject to the following terms, conditions & understandings: BCS will make reasonable efforts to locate the requested information and will make reasonable efforts to check the accuracy of any information provided. Since BCS does not prepare the underlying records its retrieves, it cannot guarantee the accuracy, timeliness or completeness of the information provided. BCS only guarantees that it will furnish all the information it has retrieved. BCS shall not be liable for any loss or injury resulting from the use of, failure to provide, or delay in receiving, such data. In the event that no information can be obtained on the subject matter(s) through our agreed efforts, CLIENT shall nevertheless be responsible for the payment of all fees agreed to be paid as specified above.

CRIMINAL AND PUBLIC RECORDS DATABASES: Once you have ordered the reports, results will be sent via email or fax. Each database contains felony convictions. In addition to felony convictions, some databases contain misdemeanor dispositions and/or traffic violations. Databases vary as to the beginning date of the data contained therein: some date back several decades, others date back to the early l990s. In general, search results from these databases show name, DOB, race, sex, offense, disposition, date of disposition, county and case number. PLEASE SEE DETAILED DESCRIPTION FOR EACH STATEWIDE DATABASE IN OUR WEBSITE - ALL SINGLE STATES AVAILABLE INSTANTLY ARE ALSO BUNDLED TOGETHER AND SEARCHED SIMULTANEOUSLY (ALL-AT-ONCE) IN OUR SUPER MULTI-STATES CRIMINAL SEARCH. Because these databases are updated monthly, quarterly and sometimes yearly, they should not be used in place of a County Courthouse level search. THE SERVICES AND MATERIALS ARE PROVIDED ON AN AS IS, AS AVAILABLE BASIS AND THE PROVIDER OF THE SERVICES AND EACH THIRD PARTY SUPPLIER OF MATERIALS EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Upon using our Statewide Services, You hereby acknowledge that we do not create or maintain these records or information, and we rely on third party sources including state departments, state repositories, correctional institutions, and other information sources. Thus we are not responsible for the content or accuracy of such records or information and we suggest that these searches should only be used as a preliminary inquiry and that a subsequent county search should be done before any action is taken against or on behalf of a subject. We shall not be liable for any loss, injury, claim, liability or damage of any kind resulting in any way from (a) errors in or omissions from the Services or Materials available or not included therein, (b) the unavailability or interruption of the Services or Materials, (c) use of the Services or Materials (regardless of whether you received any assistance from any Covered Party in using the Services or Materials), (d) your use of any equipment in connection with the Services, (e) the content of the Materials, (f) any delay or failure in performance beyond the reasonable control of a Covered Party, (g) use of the Materials or Authorized Printouts by an authorized individual, Subscriber, subscribing organization, authorized user or other third parties.


GENERAL USE OF DATA: CLIENT agrees that the information supplied by BCS strictly for its own use, and that this information will NOT be used by CLIENT for any purposes prohibited by any governmental laws, statutes, ordinances, rules and/or regulations or with the intent to stalk, harm, slander or hurt another in anyway.

COMPLIANCE WITH THE FAIR CREDIT REPORTING ACT: CLIENT agrees that any requested reports or information which maybe covered by the FAIR CREDIT REPORTING ACT must be used in full compliance with the terms and intentions of that ACT. CLIENT recognizes and understands that the FAIR CREDIT REPORTING ACT provides that anyone "who knowingly and willfully obtains information on a consumer from a consumer reporting agency under false pretenses shall be fined not more that $5,000 or imprisoned not more than one year, or both."

ANY FACSIMILE OR ELECTRONIC SUBMISSION of this agreement shall be deemed to be and shall serve as if it were the original agreement between the parties, providing all legal rights and remedies under the governing law of the STATE OF FLORIDA or other applicable governmental authorities. Client also agrees to pay any attorney's fees and court costs which we may incur in collecting any unpaid amount and agrees to pay any attorneys fees and court costs incurred by BCS in defending any lawsuit brought by client or client's representatives. Client agrees to give up right to local jurisdiction and understands and consents to any case arising from non-payment of a bill to be heard under Florida jurisdiction.
